Under the Mass Media Act of the Pridnestrovian Moldavian Republic № 263-3-111 of 2003  to be able to work in the  Pridnestrovian Moldavian Republic the foreign journalists  shall obtain accreditation at the Sate Service of Mass Media of the  Pridnestrovian Moldavian Republic. REGULATIONS
FOR THE ACCREDITATION  PROCESS IN THE 
 PRIDNESTROVIAN MOLDAVIAN REPUBLIC FOR
JOURNALISTS OF FOREIGN MASS MEDIA EDITORIALS 
AND INDEPENDENT JOURNALISTS «FREELANCERS»

1. General provisions

1. The present regulations  establishe the accreditation process of journalists of foreign mass media editorials and of independent journalists "freelancers" in the Pridnestrovian Moldavian Republic. The accreditation process is performed by the State Service of Mass Media of the  Pridnestrovian Moldavian Republic (hereafter referred to as the Mass Media Executive Authority  of the  Pridnestrovian Moldavian Republic). The present regulations do not affect the specifics of accreditation process by other Public Authorities in the Pridnestrovian Moldavian Republic.
2. To widely inform the world community about interior and international life of the  Pridnestrovian Moldavian Republic journalists of foreign mass media editorials including those which have official representative offices in the Pridnestrovian Moldavian Republic, independent journalists "freelancers" may work on the territory of the  Pridnestrovian Moldavian Republic only if they have accreditation of the Mass Media Executive Authority  of the Pridnestrovian Moldavian Republic.
3. The legal status and professional activity of the journalists of foreign mass media editorials  and of independent journalists "freelancers" accredited in the Pridnestrovian Moldavian Republic are regulated by the Constitution of the  Pridnestrovian Moldavian Republic, the current legislation of the Pridnestrovian Moldavian Republic, international treaties and the Present  Regulation.
4. For  the purposes of the Present  Regulation:
a) accreditation refers to the official recognition of the credentials of journalists of foreign mass media editorials, their representative offices and  independent journalists "freelancers" to carry out journalistic activities in the Pridnestrovian Moldavian Republic for a period specified in the accreditation by the Mass Media Executive Authority  in the Pridnestrovian Moldavian Republic. To carry out journalistic activities journalists need to have the approval of other Competent Public Authorities in accordance with the current legislation of the Pridnestrovian Moldavian Republic;
b) under the Present Regulation journalists are the editors, correspondents, photographers, cameramen, video editors and technical staff arriving with the journalist (s) of the foreign  mass media;
c) under the Present Regulation representative offices of foreign mass media are the separate subdivision of  the legal entity - foreign mass media, situated outside its location, which represents the interests of the legal entity and performs  protection of its interests.
d)  under the Present Regulation the foreign independent journalist (freelancer) is a foreign resident carrying out journalistic activities independently (as a reporter, photographer, cameraman, video editors, etc.), he must not be in an employment relationship with  foreign mass media editorials, claiming independent journalistic activities.
5. Accreditation is  performed by the Mass Media Executive Authority  in the  Pridnestrovian Moldavian Republic over the  application  of a foreign mass media editorial, its representative office and (or) independent journalist "freelancer" (hereafter referred to as  the application) after the Competent Public Authority of the Pridnestrovian Moldavian Republic receives  recommendations and ratification.
6. The journalists of foreign mass media editorials, their representative offices and independent journalists "freelancers" accredited in the Pridnestrovian Moldavian Republic  have professional status of journalists, established by the current Law on Press and Other Mass Media of the Pridnestrovian Moldavian Republic regardless of their citizenship.

2. The types of accreditation.

7. There are two types of accreditation to receive an official credential recognition of foreign mass media editorials, their representative offices and independent journalists "freelancers" in the  Pridnestrovian Moldavian Republic:
a) long term accreditation is granted for a period of one year, with an option to extend  accreditation validity  for journalists of foreign mass media editorial, their representative offices opened as required by the law of the Pridnestrovian Moldavian Republic and independent journalists "freelancers", who have the status of a legal person on the territory of the  Pridnestrovian Moldavian Republic.
b) short-term accreditation with specification of concrete dates is granted to the journalists of a foreign mass media editorial and independent journalists "freelancers" for the period of their stay in the Pridnestrovian Moldavian Republic (for the term up to three months) to report on the  timebound events or to replace  long-term accreditation in case of vacation, illness, business trip of a journalist to another country.
8. The prolongation of accreditation is made after receipt of the application of a foreign mass media editorial  and (or) independent journalist "freelancer".

3. The accreditation procedure

9. The application shall be filled in  on the official letterhead of the foreign mass media organization, signed by the head (owner) of the foreign mass media organization and (or) the application may be filled as an official letter from an independent journalist "freelancer" (for short-term  accreditation it is allowed to send the application via email, which may be sent in  *.JPG (*.JPEG), *.BMP, *.TIFF) format and shall include:
a) full name of foreign mass media organization, its information orientation (political, economic, social, cultural, sports, etc.), location of the editorial office (representative office), region of distribution, postal address, telephone numbers and Fax numbers of the editorial office, electronic communications (if available) - e-mail, ICQ, VoIP etc. (for  foreign mass media editorial);
b) a  surname, name, patronymic (if the patronymic is used) and the position of the journalist(-s) of a foreign mass media editorial and (or) of an independent journalist(-s) "freelancer (s)", submitted for accreditation;
c) goal of editors task; 
g) the period of accreditation.
10. When an independent journalist (freelancer) applies for accreditation, the Mass Media Executive Authority  of the  Pridnestrovian Moldavian Republic has the right to request additional information about the professional activities of an independent journalist (freelancer) (for example, the approximate information and other materials posted on websites, published, broadcast for the previous periods but not earlier than three years ago).
11. Two photos (3x4 cm) of a journalist(-s) of a foreign mass media editorial  and (or) an independent journalist(-s) "freelancer (s)" to be accredited  shall be attached to the application.
12. The following documents shall be submitted for long-term accreditation:
a) the certificate of the editorial staff of the mass media organization at the representative office (name, position, passport data);
b) the state registration certificate of legal entity in the  Pridnestrovian Moldavian Republic, an extract from the Unified Government  Register of Legal Entities of the Pridnestrovian Moldavian Republic in Russian language.
13. The applicant shall give the original certificate of state registration of legal entities in the Pridnestrovian Moldavian Republic and its copy which shall be certificated by the Mass Media Executive Authority of the Pridnestrovian Moldavian Republic , or a notarized extract from the Unified Government  Register of Legal Entities. The original certificate shall be returned to the applicant;
c) an extract from the Unified Government  Register of Rights to Real Estate and it’s Transactions on the territory of the Pridnestrovian Moldavian Republic. If the Estate was registered before 2001, a certificate from the Property Inventory and Registration Authority shall be furnished.
If ownership of immovable property is based on the lease agreement not requiring state registration,  a notarized copy of the lease agreement shall be submitted;
g) the certificate of payments status of the legal entity (representative office)  into the budget issued by the Tax Authority of the Pridnestrovian Moldavian Republic at the place of registration of the legal entity.
14. The application is submitted to the Head of the Mass Media Executive Authority of the Pridnestrovian Moldavian Republic.
15. To receive a short-term accreditation the application may be sent to the Mass Media Executive Authority of the Pridnestrovian Moldavian Republic to the postal address – 3300, Tiraspol, St. Engels, 5, by Fax (+373 533) 6-07-02 or email infoplanpmr@yandex.com
The application shall be submitted 30 (thirty) days before  the accreditation date specified in the application, in case it is not possible to keep the date stated in the application, the applicant shall submit  a reasoned petition.
16. The application submitted the Mass Media Executive Authority of the Pridnestrovian Moldavian Republic shall be considered adopted from the moment of its registration at the secretariat of the Mass Media Executive Authority of the Pridnestrovian Moldavian Republic.
17. The application for accreditation filled in with violation of requirements of the Present  Regulation shall be returned to the foreign mass media editorial and (or) an independent journalist "freelancer" within 2 (two) working days from the date of registration with specification of the reasons for return. 
This circumstance does not deprive a foreign mass media editorial and (or) an independent journalist "freelancer" right of re-submission of a duly completed application.
18. The Mass Media Executive Authority of the Pridnestrovian Moldavian Republic undertakes the preliminary review  of a duly completed application during 4 (four) working days from the date of its adoption. Denial of accreditation is possible in the case the specified data do not correspond to reality.
19. After the preliminary review of the application within 4 (four) working days the Mass Media Executive Authority of the Pridnestrovian Moldavian Republic submits the application for approval to other Competent Public Authorities of the Pridnestrovian Moldavian Republic, that give their recommendations to days the Mass Media Executive Authority of the Pridnestrovian Moldavian Republic.
20. Denial of accreditation is possible in the case if:
a) provided in the application data do not correspond to reality, photos and other documents, set out in the Present  Regulation are not attached to the application, 
b) the application is submitted with the breach of time limits set by the  Present  Regulation;
c) a journalist of a foreign mass media editorial and (or) an  independent journalist "freelancer" has already accreditation;
d) a foreign mass media editorial and (or) an independent journalist "freelancer",  his/her representatives distributed information that does not correspond to reality, violates the honor and dignity of citizens and (or) can be harmful to the business reputation of the organizations in the Pridnestrovie and (or) to the interests of the Pridnestrovian Moldavian Republic, as well as distribution of false information that may cause harm to the friendly relations between States;
e) a journalist of a foreign mass media editorials  and (or) an independent journalist "freelancer" has already carried out journalistic activities in the Pridnestrovian Moldavian Republic without receiving accreditation;
f) a journalist of a foreign mass media editorial  and (or) an independent journalist "freelancer" was previously deprived of accreditation on the territory of the Pridnestrovian Moldavian Republic;
g) the Competent Public Authority has sent a letter that  accreditation of a journalist (s) of a foreign mass media editorial  and (or) an independent journalist "freelancer" is  unagreed.
21. The decision on accreditation is taken by the order of the Mass Media Executive Authority of the Pridnestrovian Moldavian Republic..
22. The Mass Media Executive Authority of the Pridnestrovian Moldavian Republic informs about the results of consideration of the application the foreign mass media editorial and (or) independent journalist "freelancer" who  submitted the application not later than 2 (two) working days before the start date of accreditation mentioned in the application.
To accelerate the accreditation procedure the foreign mass media editorial and (or) an independent journalist "freelancer" can be informed about the positive solution via the phone number or email address mentioned in the application.
The Denial of accreditation is issued in the form of an official letter signed by the Head of the State Service of Mass Media and shall contain the reasons of refusal.
23. A journalist (s) of a foreign media and (or) an independent journalist "freelancer", who has applied for the accreditation successful receives from the Mass Media Executive Authority of the Pridnestrovian Moldavian Republic an appropriate identification card (accreditation card) (hereafter referred to as – accreditation certificate).
24. The professional activities of a journalist of a foreign mass media editorial and (or) an independent journalist "freelancer" without an accreditation certificate is not allowed.
25. When carrying out journalistic activities on the territory of the Pridnestrovian Moldavian Republic journalist(s) of a foreign mass media editorial and (or) an independent journalist "freelancer" shall provide an accreditation certificate and the document proving the identity at the request of authorized entities.
26. A journalist of a foreign mass media editorial and (or) an independent journalist "freelancer" gets the accreditation certificate personally, not later than the start date of accreditation, it shall be noted that an appropriate note is entered to the registration book of accreditation certificates  on the territory of the Pridnestrovian Moldavian Republic.
The accreditation certificate includes:
a) ID number;
b) the date of issue;
c) the name of a foreign mass media organization (for a foreign mass media editorial);
d) name and surname (in initials) of an accredited journalists and (or) an representative of a foreign mass media organization;
d) the period of accreditation.
27. An accreditation certificate shall be signed by the Head of the Mass Media Executive Authority of the Pridnestrovian Moldavian Republic and shall  be certified by the official seal.
4. Termination and deprivation of accreditation
28. The accreditation is terminated if:
a) the activities of a  foreign mass media organization are suspended or terminated;
b) the civil legal and labor relations of an accreditated journalist with a foreign mass media editorial are terminated;
c) an accredited journalist is recalled by a foreign mass media editorial;
d) the date of  accreditation is expiried;
e) the journalist is deprived of accreditation.
29. If the civil legal and labor relations of an accreditated journalist with a foreign mass media editorial are terminated or  the accredited journalist is recalled by a foreign mass media editorial, the foreign mass media editorial shall inform in written form about this issue the Mass Media Executive Authority  of the  Pridnestrovian Moldavian Republic.
30. A foreign mass media editorial can apply for accreditation of another journalist after the return of the previously issued accreditation certificate.
31. A journalist(s) of a foreign mass media editorial and (or) an independent journalist "freelancer" can be denied  accreditation if:
a) the journalist of a foreign mass media editorial and (or) an independent journalist "freelancer has broken the rules of accreditation or distributed untrue information discrediting the honor and dignity of the organization that accredited journalists and (or) an independent journalist "freelancer", and  that is confirmed by a legally effective court decision.
b) the journalist of a foreign mass media editorial and (or) an independent journalist "freelancer" defies the current legislation of the Pridnestrovian Moldavian Republic 
c) the journalist of a foreign mass media editorial and (or) an independent journalist "freelancer" disseminates information which is prohibited by the current legislation of the Pridnestrovian Moldavian Republic, or prejudicial to the interests of citizens, organizations and (or) state.
32. If the journalist of a foreign mass media editorial and (or) an independent journalist "freelancer" is deprived of  accreditation,  the Mass Media Executive Authority  of the  Pridnestrovian Moldavian Republic  shall publish the information in the message form in the Republican newspaper "Pridnestrovie" within 4 (four) working days that the accreditation certificate registered under the specified in the information message id number is deemed barred  and send a written notification to the journalist that he/she is  deprived of his/her  accreditation.
33. The journalist of a foreign mass media editorial and (or) an independent journalist "freelancer" deprived of accreditation is required to return the accreditation certificate to the Mass Media Executive Authority  of  the  Pridnestrovian Moldavian Republic  within two (2) working days after  receipt a written notice of deprivation of  accreditation from the Mass Media Executive Authority  of the  Pridnestrovian Moldavian Republic.
34. Re-accreditation of a journalist of a foreign mass media editorial and (or) an independent journalist "freelancer" who was deprived of accreditation is not allowed.
35. The decision on the denial of accreditation or deprivation of accreditation may be appealed in court in accordance with the procedure established by law of the Pridnestrovian Moldavian Republic.
